1. Acceptance of Terms

Welcome to MakeMyThumb ("Service," "we," "our," or "us"). By accessing or using our website at makemythumb.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Description of Service

MakeMyThumb is a professional thumbnail creation service that connects users ("Customers") with designers ("Managers") to create custom YouTube thumbnails. Our Service allows you to:

  • Purchase credits to request custom thumbnails
  • Submit thumbnail design requests with specifications
  • Receive professionally designed thumbnails from our team
  • Download completed thumbnails for your use

3. Account Registration

To use certain features of our Service, you must create an account. You may register using:

  • Google OAuth (recommended)
  • Email with magic link authentication

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account
  • Be at least 13 years of age (or the age of majority in your jurisdiction)

4. User Roles

4.1 Customers

As a Customer, you can purchase credits, submit thumbnail requests, and download completed thumbnails.

4.2 Managers (Designers)

Managers are authorized designers who claim and fulfill thumbnail requests. Manager status is granted by administrators.

4.3 Administrators

Administrators manage users, oversee requests, and maintain the platform.

5. Credits and Payments

5.1 Credit System

  • 1 USD = 100 credits
  • 1 thumbnail request = 500 credits ($5)
  • Credits are non-refundable except as specified in Section 7
  • Credits do not expire
  • Credits are non-transferable between accounts

5.2 Payments

All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service. We do not store your full credit card information.

5.3 Pricing

We reserve the right to modify our pricing at any time. Price changes will not affect credits already purchased.

6. Thumbnail Requests

6.1 Request Submission

When submitting a thumbnail request, you must:

  • Provide a clear title and detailed description
  • Specify your design requirements and preferences
  • Optionally provide reference URLs or examples
  • Ensure you have sufficient credits (500 credits per request)

6.2 Request Fulfillment

  • Requests are fulfilled on a first-come, first-served basis
  • Typical turnaround time is 24-48 hours (not guaranteed)
  • You will be notified when your thumbnail is ready
  • Completed thumbnails are available for download from your dashboard

6.3 Revisions

We strive for customer satisfaction. If you are not satisfied with your thumbnail, please contact us at support@makemythumb.com. Revision requests will be evaluated on a case-by-case basis.

7. Refunds and Cancellations

7.1 Credit Purchases

Credits are generally non-refundable. However, we may issue refunds at our discretion in cases of:

  • Billing errors
  • Service unavailability
  • Other exceptional circumstances

7.2 Request Cancellations

  • Before assignment: If your request has not been claimed by a designer, you may cancel for a full credit refund
  • After assignment: Requests cannot be cancelled once claimed

8. Intellectual Property

8.1 Your Content

You retain ownership of any content (descriptions, reference materials) you provide. By submitting content, you grant us a license to use it solely for the purpose of creating your thumbnail.

8.2 Completed Thumbnails

Upon delivery and payment, you receive full commercial rights to use the completed thumbnail for your YouTube channel or other purposes. You may not resell or redistribute the thumbnail as a standalone product.

8.3 Our Intellectual Property

The MakeMyThumb website, logo, design, and all related intellectual property are owned by us and protected by copyright and trademark laws.

9. Prohibited Uses

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Request thumbnails containing illegal, offensive, or inappropriate content
  • Violate any laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use automated tools to access the Service without permission
  • Impersonate others or misrepresent your affiliation
  • Request thumbnails that violate YouTube's Terms of Service

10. Content Guidelines

We reserve the right to refuse any request that contains:

  • Illegal content
  • Hate speech or discriminatory content
  • Sexual or pornographic content
  • Violence or graphic content
  • Copyright or trademark infringement
  • Misleading or deceptive content

Requests deemed inappropriate will be cancelled with a full credit refund.

11. Disclaimers and Limitation of Liability

11.1 Service "As Is"

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11.3 No Guarantee of Results

While we strive to provide high-quality thumbnails, we cannot guarantee specific results, views, or success for your YouTube channel.

12. Indemnification

You agree to indemnify and hold harmless MakeMyThumb, its affiliates, and its employees from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you submit to the Service

13. Termination

13.1 Termination by You

You may close your account at any time by contacting us. Upon account closure, any unused credits will be forfeited.

13.2 Termination by Us

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Misuse the Service
  • Fail to pay for services rendered

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MakeMyThumb operates, without regard to its conflict of law provisions.

15.2 Dispute Resolution

In the event of a dispute, you agree to first contact us to seek an informal resolution. If we cannot resolve the dispute informally, any legal action must be brought in the appropriate courts of our jurisdiction.

These Terms constitute the entire agreement between you and MakeMyThumb regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights without restriction.
